DMCA compliance

GoomView Hub Inc. complies with the Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512). If you are the owner of copyrighted material that you believe has been reproduced on the Site without authorization, you may submit a takedown notice.

How to file a notice

Send your notice in writing to our designated DMCA agent (contact details below). To be valid under the DMCA, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner (or a person authorized to act on their behalf).
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with sufficient detail (URL, page title) for us to locate it.
  4. Your contact information: name, address, telephone number, email.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

Counter-notification process

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. To be valid, it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email.
  5. A statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the U.S., the District of Delaware), and that you will accept service of process from the person who provided the original takedown notice.

Upon receipt of a valid counter-notification, we will forward it to the original claimant. If they do not file a court action within 10-14 business days, we may restore the removed content.

Repeat infringers

It is our policy to terminate the accounts of users (including reader-review contributors) who are determined to be repeat infringers.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing - or that material was removed by mistake or misidentification - may be liable for damages, including costs and attorneys' fees. Please be honest.
